These Terms of Use (these “Terms” or the “Agreement”) are a legally binding agreement between you as the user (“you”) and Junk Bull LLC (collectively, “Junk Bull,” “we,” “us,” or “our”). These Terms govern your access to and use of this website, as well as any related mobile sites or platforms that link to this Agreement (each a “Site” and collectively, the “Sites”), including all content, features, and functionality provided on or through the Sites. By continuing to use our Sites, you agree that such use constitutes legally sufficient consideration under this Agreement. This Agreement is in addition to any specific terms applicable to services you may order or request through the Sites.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITES, AS THEY AFFECT YOUR LEGAL RIGHTS. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT THAT LIMITS YOUR RIGHTS TO BRING AN ACTION IN COURT, BRING A CLASS ACTION, OR HAVE DISPUTES DECIDED BY A JUDGE OR JURY, AS WELL AS PROVISIONS THAT LIMIT OUR LIABILITY TO YOU.

BY ACCESSING THIS SITE, YOU REPRESENT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ANY OF THESE TERMS, YOU MAY NOT USE THIS SITE.

1. Use of the Site

a. License

Subject to your compliance with these Terms, Junk Bull grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Sites for lawful purposes. Any other use is strictly prohibited and constitutes a violation of these Terms. Junk Bull reserves all rights not expressly granted herein, including all intellectual property and ownership rights in the Sites and all related content.

b. Revision of These Terms

We may revise these Terms from time to time. We will use reasonable efforts to notify you of changes (e.g., by posting a notice on the Sites or sending an email if you have an account with us). The “Last Updated” date at the top of this page indicates when the Terms were last modified. Your continued use of the Sites after the effective date of any revisions constitutes your acceptance of the updated Terms. We encourage you to review this page regularly.

c. Operation of the Sites

Junk Bull reserves the right, at its sole discretion, to modify, suspend, or discontinue any part of the Sites or any services offered through them at any time, without notice or liability.

2. Prohibited Uses

You agree that you will not:

  • Violate these Terms or use the Sites to infringe the rights of any third party (e.g., copyright, trademark, or other intellectual property rights);

  • Provide false, inaccurate, or misleading information, including using a fake name or email address;

  • Reproduce, distribute, display, or create derivative works from any Site content without our express written permission;

  • Reverse engineer, decompile, or attempt to extract source code from the Sites;

  • Upload files containing viruses, malware, or other harmful code;

  • Scrape, crawl, or otherwise extract data from the Sites using automated means (e.g., bots, scripts) without our prior written consent;

  • Impersonate any person or entity or misrepresent your affiliation with another;

  • Use the Sites for any unlawful purpose or in any way that could damage, disable, or impair the Sites or their functionality;

  • Link to the Sites from any third-party site that is misleading, defamatory, or contains objectionable or illegal content;

  • Charge others for access to the Sites or any content on them;

  • “Frame” or “mirror” any part of the Sites;

  • Assist or encourage others in any of the above prohibited activities.

3. Representations and Warranties

You represent and warrant that:

  • You have the legal capacity and authority to enter into this Agreement;

  • Your use of the Sites complies with all applicable laws and does not breach any other agreement you are bound by;

  • Any contact information you provide (e.g., email, phone number) is accurate and you have permission to share it;

  • You are not a competitor of Junk Bull and are not using the Sites for competitive purposes;

  • You are solely responsible for the confidentiality and security of your account credentials (if applicable).

4. Intellectual Property

All content on the Sites—including text, graphics, logos, icons, images, software, and site architecture—is the property of Junk Bull or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or exploit any Site content except as expressly permitted in these Terms. All rights not granted herein are reserved.

5. Privacy

We respect your privacy. Please review our Privacy Policy for details on how we collect, use, and protect your personal information.

6. Indemnification

You agree to indemnify, defend, and hold harmless Junk Bull, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from:
(i) your use of the Sites;
(ii) your breach of these Terms; or
(iii) your violation of any third-party rights.

We reserve the right to assume control of the defense of any such claim. You agree to cooperate fully with us in such defense.

7. Third-Party Sites

The Sites may contain links to third-party websites or services. We do not endorse, monitor, or assume responsibility for their content, privacy practices, or availability. Your use of third-party sites is at your own risk.

8. Disclaimer of Warranties

YOUR USE OF THE SITES IS AT YOUR SOLE RISK. THE SITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JUNK BULL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF SITE CONTENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUNK BULL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD, REGARDLESS OF THE CAUSE OF ACTION.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10. Dispute Resolution and Arbitration

a. Binding Arbitration

You and Junk Bull agree that any dispute arising from these Terms or your use of the Sites will be resolved by binding arbitration (administered by JAMS under its Comprehensive Arbitration Rules), not in court, except for claims in small claims court or actions to protect intellectual property.

b. Class Action Waiver

All claims must be brought in your individual capacity only. Class actions, class arbitrations, and representative proceedings are expressly waived.

c. Notice Requirement

Before initiating arbitration, you must send a written Notice of Dispute to:

The Notice must describe the nature of your claim and the relief sought. If we cannot resolve the issue within 30 days, either party may proceed to arbitration.

d. Exceptions

Nothing in this section prevents either party from seeking injunctive relief in court to prevent irreparable harm (e.g., intellectual property infringement).

11. SMS Terms (if applicable)

If you opt in to receive text messages from Junk Bull:

  • You consent to receive recurring marketing or service-related SMS messages via an automated system.

  • Message and data rates may apply.

  • Reply “STOP” to unsubscribe at any time.

  • Reply “HELP” for support.

  • Supported carriers include all major U.S. providers.

12. Miscellaneous

  • No Assignment: You may not assign these Terms. We may assign them freely.

  • Entire Agreement: These Terms constitute the full agreement between you and Junk Bull regarding the Sites.

  • Severability: If any provision is found invalid, the rest remains in effect.

  • Waiver: Our failure to enforce a right is not a waiver of that right.

  • Notices: All legal notices to us should be sent to info@junkbull.com.

  • Governing Law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
